Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the https://southnorfolkbusinessdirectory.com website (the “Service”) operated by South Norfolk Business Directory (“SNBD,” “us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Copyright Infringement

SOUTH NORFOLK BUSINESS DIRECTORY (SNBD) is committed to complying with U.S. copyright law and expects all who access our websites, including subscribers and members, to do the same. The Digital Millennium Copyright Act of 1998 (“DMCA”) provides recourse for owners of copyrighted material who believe that their rights under U.S. copyright law have been infringed on the internet. Under the DMCA, copyright owners may contact the authorized agent of an internet service provider to report alleged infringements of their protected works appearing on web pages hosted by the service provider. Upon receipt of a properly filed complaint satisfying the requirements of the DMCA, SNBD will remove or block access to the allegedly infringing material. If a person believes in good faith that a notice of copyright infringement has been wrongly filed, such person may submit a counter-notice to SNBD. SNBD shall not be made a party to disputes over alleged copyright infringement.

If you believe that your copyrights have been infringed, or if a notice of copyright infringement has been filed against you, you should seek advice of legal counsel. We are providing the following information to you for informational purposes only.

Notification of Claimed Copyright Infringement

If you believe that a listing or other content in the SNBD is violating your rights under U.S. copyright law, you may file a complaint thereof with SNBD’s designated agent in the manner described below.

For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:

(a) a physical or electronic signature of a person authorized to act on behalf of the copyright owner;

(b) identification of the copyrighted work claimed to have been infringed;

(c) identification of the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed or access to which is to be disabled as well as information reasonably sufficient to permit NVIDIA to locate the material;

(d) information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number and, if available, an electronic mail address;

(e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and

(f) a statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

You should be aware that, under the DMCA, claimants who make misrepresentations concerning copyright infringement may be liable for damages incurred as a result of the removal or blocking of the wrongfully accused material, court costs, and attorneys’ fees.

Counter-Notification to Claimed Copyright Infringement

If a notice of copyright infringement has been filed against you, you may file a counter-notification with NVIDIA’s designated agent at the address listed above. Such counter-notification must contain the following information:

(a) a physical or electronic signature;

(b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;

(c) a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and

(d) your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the federal district in which you are located, and that you will accept service of process from the complainant.

If SNBD receives a valid counter-notification, the DMCA provides that the removed material will be restored or access re-enabled.

You should be aware that U.S. copyright law provides substantial penalties for a false counter-notice filed in response to a notice of copyright infringement.

E-Commerce

The South Norfolk Business Directory offers basic listings free.  Listings with added features are available for a small fee.

Disclaimer of liability

Use of this site constitutes your acceptance of the Terms.

Listing Agents and site users may not hold SNBD liable in the event of product or listing failure. Listing Agents and SNBD will not be responsible for in the event of any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by the website users or the customers of Listing Agents.

Intellectual Property/Trademarks

Trademarks, images, artwork and content belong exclusively to SNBD, and SNBD does not grant any license or right to use any trademark without the prior written consent.

Payment

Full payment is required when a Listing Agent chooses a featured listing on this website. No features will appear until payment has been received and cleared. When payments fail, SNBD has a right to cancel the listing completely.

Data Protection

SNBD is hosted on a secured virtual private network. Payment is through the Paypal gateway, and you can pay with Paypal, credit card, debit card or check. Checks must clear before listings features above the free-listing level are activated.

SNBD stores only your SNBD account information: name, username, and website. We may email you one day with important information regarding your SNBD listing account or membership.

Your payment details such as account numbers, card numbers, expiration dates, names and addresses are not stored by SNBD at all. Because SNBD is secured, any data you send through our forms is encrypted for your safety.

Our forms are protected against hacking and bot submission using RECAPTA.

Delivery Terms

SNBD does not sell any tangible products at this time.

Product Information & Warranties

Basic SNBD Listings are free. Users who want to claim and control a listing may do so without charge, once we are satisfied of the ownership or affiliation of the User/Potential Listing Agent.

Paid listings may be purchased by anyone over 18, provided they have a business in, or one that serves, South Norfolk, in Chesapeake, Virginia in the USA.

Paid listings may be purchase through our Paypal Gateway using a credit card, debit card, or Paypal account. No Paypal account is required.

Warranty

SNBD offers no warrant for satisfaction of our listing services.

Right to cancel

Listing agents may cancel their listings or their payment plans at any time. SNBD does not refund payments for any reason. If you are dissatisfied with your listing, contact SNBD for help.

External Links are often provided on sites for the user’s convenience but the links, and the related content, are outside of the control of the SNBD, its Listing Agents and its users. Use of the South Norfolk Business Directory is at the User’s/Listing Agent’s own risk.

Website Terms of Use

The South Norfolk Business Directory is available to anyone in the US with internet access. Some countries are blocked for security. If you are in a foreign country and are unable to access SNBD, use the contact form to let us know.

We do not store any purchase-related information; that information is stored by our payment gateway, Paypal.

We do store usernames and emails. We may email you sometime with an important message, but we do not sell or share your data with any other parties.

We expect users and Listing Agents to use the SNJB in positive ways to promote business in South Norfolk. We expect comments and ratings to be respectful, and we reserve the right to ban anyone from the site, cancel accounts and remove listings without cause or explanation.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for choosing a user name that is not offensive, misleading, or a purposefully masquerading or impersonating of any real person who is not you.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by South Norfolk Business Directory.

South Norfolk Business Directory has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that South Norfolk Business Directory shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

These Terms shall be governed and construed in accordance with the laws of Virginia, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
